PESHAWAR – In a major, dramatic development in Khyber Pakhtunkhwa politics, prominent lawyer and MNA Sher Afzal Marwat has formally approached Federal Constitution court , filing a high-profile constitutional petition challenging the controversial removal of former Chief Minister Ali Amin Gandapur.

The petition seeks to nullify the appointment of incumbent Chief Minister Muhammad Sohail Afridi, bringing the party’s internal turmoil and constitutional questions directly to the court’s attention.

Marwat, acting as an outspoken legal advocate despite past public differences within the party leadership, filed a comprehensive writ petition raising key constitutional points. Marwat argues that a provincial chief executive cannot be legally or constitutionally pressured to resign under pressure from a non-parliamentary party. They claim that the procedure was used to force Gandapur to ignore the proper votes of the parliamentary party.

The legal filing leans towards the contradiction that a political change decided by an imprisoned or convicted person lacks the constitutional standing to legally dissolve the provincial cabinet functioning under Article 130. If Ali Amin Gandhapur claimed that he was forced to resign, then the petition will be strongly considered to declare the removal of the former CM as null and void.

The petition has requested the court to issue a writ of quo warranto, asking the sitting chief minister to prove under what authority he holds the position, arguing that the vacancy was never legally created.
