‎The Peshawar High Court has dismissed a petition filed by police officers and upheld an order to register an FIR against them in a case of alleged illegal detention and fake FIRs.

‎A two-member bench comprising Justice Sahibzada Asadullah Khan and Justice Inamullah Khan issued a written order maintaining the decision of Additional District and Sessions Judge Imtiaz Ali. The lower court had directed that an FIR be registered against SHO Rafiq Khan, Sub-Inspector Humayun Khan, and Constable Usman.

‎According to court records, Peshawar resident Mian Amjad Khan had stated that he was kept in illegal detention for 14 days and was later nominated in two allegedly fake FIRs.

‎The judgment also noted that a court bailiff recovered Mian Amjad Khan from a private room at a CNG station in the presence of police, with handcuffs on.

‎The police officers had challenged the sessions court’s order in the Peshawar High Court. During the hearing, Advocate Umar Khan Utmanzai of Bukhari & Khan Law Firm appeared for the petitioner and presented detailed arguments regarding the alleged misuse of authority and illegal actions by the police personnel.

‎After hearing both sides, the PHC bench rejected the officers’ petition and ruled that the FIR must be registered against the concerned police officials as previously ordered by the Additional District and Sessions Judge.
