PESHAWAR: The court dismissed the petitions filed by the employees against the abolition of free electricity units and declared the government’s decision to provide monetary allowance as legal.
The decision of the caretaker federal government to abolish the free electricity facility and convert it into a monetary allowance was within the legal limits, the decision said. The provision of free electricity units was not a permanent or irrevocable legal right but an administrative concession, the decision said.
Such a concession can be changed or abolished under changing economic conditions and national interest. This step of the caretaker government was for the continuity of the policy and administrative improvement.
The continuation of this policy by the elected government further strengthens its legal status, the decision. This change is in accordance with Articles 4 and No violation of Article 25, verdict. The administrative arrangements cannot take the form of permanent legal rights with the passage of time, the verdict.
The concerned authorities should ensure the implementation of this policy in a transparent, fair and uniform manner, the verdict said.
