The Federal Constitutional Court dismissed the appeal of a private bank in the online bank fraud case and directed the return of the citizen’s money. Justice Aamir Farooq remarked that hackers are inside the banking system, and it is the duty of banks to secure their systems.

A two-member bench headed by Justice Aamir Farooq heard the case related to online bank fraud in the Federal Constitutional Court. The court dismissed the appeal of the private bank and directed the return of the money to the affected citizen. Rs 1.534 million was withdrawn from the account of a Layyah resident in 2022.

During the hearing, Justice Aamir Farooq remarked that all hackers are inside the banking system. He said that the account is opened later, but the hackers reach the user’s data first. Justice Aamir Farooq revealed that he has also received calls from fraudsters. He said that he had an account in a private bank where they called and asked to share the OTP, or else the account would be blocked.

According to Justice Amir Farooq, since there had been no transaction in the account for several years, he asked the bank to close the account. He remarked that he himself does not use online accounts, while it is the duty of banks to strengthen their systems.

Justice Amir Farooq raised the question of where people go and how money is withdrawn from the accounts. The private bank’s lawyer took the position that the citizen himself had transferred the money through his app, while the citizen said that his mobile number had been stolen.

The court remarked that the Banking Ombudsman, the President of the State Bank, and the High Court have already given a decision against the bank, while the Federal Constitutional Court also dismissed the appeal.
