PESHAWAR: The Peshawar High Court (PHC) disposed of a supplementary petition after assurance that the body of Mumtaz alias Mumtazay, who was killed last night and was wanted in 47 cases, will be handed over to his heirs, on Tuesday.

The court also directed police to hand over the body to the real heirs and not to create any hurdle in the burial process.

A two-member bench comprising Justice Syed Arshad Ali and Justice Babar Sattar heard the supplementary petition filed by Mumtaz’s mother, Bagh Meena.

The petitioner’s counsel Shabbir Gigyani told the court that on Monday the accused Mumtaz was being transferred from Islamabad Airport to Peshawar when armed men attacked the police. In the attack, the accused Mumtazay wanted by the police, and two attackers were killed. The body of the killed accused is not being handed over to the heirs, therefore this petition was filed.

Justice Syed Arshad Ali asked: “Who is not handing over the body? Who has it? Tell us.” Additional Advocate General Abdul Rauf Afridi and DSP Legal appeared in court.

The AAG told the court that police are ready to hand over the body, however police’s stance is that they will hand over the body to the real heirs, not to anyone else.

The petitioner’s counsel told the court that the deceased’s mother and brother will go and hand over the body to them. He also requested that no hurdle be created in the burial.

The AAG informed the court that the body is currently at the hospital. He requested that hospital administration be directed to record a video of the body so that record is available.

The court directed that the deceased’s body be handed over to the heirs and said that hospital administration should keep a video record of the body.
