PESHAWAR: The Provincial Assembly Secretariat has issued a formal letter to the police regarding the arrest, detention or custody of members of the provincial assembly.
The letter has been sent to the Inspector General (IG) of Khyber Pakhtunkhwa Police.
According to the letter, the secretariat directed that Section 11 of the Khyber Pakhtunkhwa Assembly Powers, Immunities and Privileges Act 2026 must be strictly complied with.
Prior permission from the Speaker of the Assembly will be required before arresting an MPA in a criminal case or taking him/her into custody on a judicial order.
The police will have to provide the Speaker with reasons for the arrest or detention of the member in a prescribed form.
The Speaker may also seek a police report or challan from the concerned police officer.
The provincial assembly secretariat instructed police authorities to ensure strict implementation of the prescribed procedure for arrest or detention of assembly members.
What is Section 11
It gives special protection to sitting MPAs. Police cannot arrest, detain or take custody of any MPA without prior written permission from Speaker. Speaker can also ask for FIR, police report and challan.
This is similar to National Assembly rules where Speaker must be informed. KP is the first province to make it a strict law with a prescribed form.
The move comes at a time when PTI’s Islamabad march is planned and tensions between KP Govt and Centre / Police are high.
