PESHAWAR (Kamran Ali Shah) The Peshawar High Court (PHC) has dismissed a petition filed against the appointment and promotion of Secretary Khyber Pakhtunkhwa Assembly Syed Waqar Shah.
The High Court, in its detailed judgment, held that the petitioner, former Legal Advisor Ali Azeem Afridi, failed to prove the allegations levelled against the Secretary of the Assembly, after which the appointment and promotion of Syed Waqar Shah were upheld legally.
The court clarified that all stages of the appointment, upgradation and promotion of the Secretary of the Assembly were carried out strictly in accordance with the prevailing laws and rules, and no malice or illegal action could be proven in it.
The judgment further stated that the appointment of an official cannot be declared null and void based on mere allegations, and the objections of the petitioner are devoid of any solid documentary or legal basis.
The learned court also emphasised in its judgment that this petition appears to be based on personal differences rather than public interest.
The court took notice that the petitioner had filed several cases against Secretary Syed Waqar Shah in the past as well, which appeared to be more of a matter of personal vendetta than legal.
The court dismissed the petition as devoid of merit and inadmissible and upheld the appointment of Syed Waqar Shah as a matter of jurisdiction of the competent authority.
