ISLAMABAD: The Federal Constitutional Court has upheld the Peshawar High Court’s decision in a case involving the appointment of a postgraduate degree holder as a sweeper in Khyber Pakhtunkhwa, dismissing an appeal filed by the provincial government.
A three-member bench headed by Justice Hasan Azhar Rizvi heard the case and made critical observations regarding the employment of a person holding a Master’s degree in a sanitation position.
During the hearing, Justice Rizvi questioned whether a person with an MA qualification should be assigned duties as a sweeper. However, the court noted that since the employee had been serving in the position for the past decade, removing him from service would not be an appropriate solution.
The court suggested that the provincial government consider providing the complainant with a more suitable position.
During proceedings, the Additional Advocate General informed the court that there was currently no vacant sweeper position available in Khyber Pakhtunkhwa. Responding to the statement, Justice Rizvi questioned whether the province had become so clean that it no longer required sweepers.
The District Education Officer also appeared before the court, which asked about the duties being performed by the employee. The officer informed the bench that the employee was responsible for cleaning work, including sweeping.
Justice Rizvi expressed concern over the situation, stating that it reflected a serious issue within the system for a person with a Master’s degree to be working as a sweeper.
At the conclusion of the hearing, the Federal Constitutional Court maintained the Peshawar High Court’s ruling and rejected the Khyber Pakhtunkhwa government’s appeal.
