ISLAMABAD: After the Pakistan Army, the judiciary has also set a high example of self-accountability by ruling against Justice Tariq Mahmood Jahangiri in the fake degree case.
On Thursday, the Islamabad High Court, in an important ruling, declared the appointment of former Justice Tariq Mahmood Jahangiri as a judge null and void and declared him ineligible for the position. The court has stated in its ruling that Tariq Mahmood Jahangiri’s LLB degree has been proven to be fake, due to which he failed to fulfill the legal requirements during his service.
The verdict in Tariq Mahmood Jahangiri’s fake degree case was announced by a two-member bench comprising Justice Sarfaraz Dogar and Justice Azam Khan. The court ruling said that it has been proven from the evidence that Justice Tariq Mahmood Jahangiri did not have a valid and authentic LLB degree, which is a basic requirement for the position of a judge.
The court made it clear that there can be no compromise on transparency and merit in the judiciary; therefore, a person with fake educational certificates cannot hold this position.
The Islamabad High Court has also ordered to send a formal copy of this decision to the Ministry of Law so that necessary legal and administrative action can be taken in the future. According to legal experts, this decision is being seen as an important precedent regarding transparency and accountability in the judicial system.
Meanwhile, the Islamabad High Court has also rejected the applications to constitute a full court bench against the decision related to the fake degree case of Tariq Mahmood Jahangiri.
It should be noted that Justice Tariq Mahmood Jahangiri of the Islamabad High Court had challenged the action of the High Court in the Federal Constitutional Court in the case related to the degree dispute against him. Justice Tariq Mahmood Jahangiri had filed an appeal in the Constitutional Court against the order of the two-member bench of the Islamabad High Court issued on December 9.
The petition argued that the writ petition filed against Justice Tariq Mehmood Jahangiri in the Islamabad High Court was not maintainable, therefore, the proceedings should be declared null and void. In the petition filed in the Federal Constitutional Court, Justice Tariq Jahangiri requested that the writ filed against him in the Islamabad High Court be dismissed.
According to sources, Justice Tariq Jahangiri had also formed a legal team consisting of 3 senior lawyers to challenge the proceedings of the Islamabad High Court. This legal team included Akram Sheikh and Barrister Salahuddin. It may be recalled that during the previous hearing held in the Islamabad High Court, Justice Tariq Jahangiri had objected to the presence of Chief Justice Islamabad High Court Justice Sarfaraz Dogar in the bench and expressed no confidence in the bench.
After this development, special attention has been paid to this matter in judicial circles and the case is being described as an important constitutional matter.
