PESHAWAR: The Peshawar High Court (PHC) has issued a detailed judgment concerning the appointment of teachers and non-administrative staff to administrative positions in universities across Khyber Pakhtunkhwa.
The eight-page judgment, authored by Justice Kamran Hayat Miankhel, came in a case challenging the long-term appointment of teaching and non-administrative staff to administrative posts in the province’s universities.
The court directed universities to ensure that relevant administrative officers are appointed to administrative positions in accordance with the law.
It was also mentioned in the ruling that the universities have to strictly follow Section 17-A of the Universities Act, 2012 while making appointments to administrative positions.
It was further stated by the court that if there is no competent administrative officer for an appointment to a specific post, then the process of appointment should be carried out in accordance with relevant laws.

The Peshawar High Court has also made it clear that the teachers and other non-administrative staff members should not be permanently retained in administrative positions.
The PHC has also ordered the universities of Khyber Pakhtunkhwa to review their current practice regarding the appointments of administrative positions.
The ruling also highlighted the importance of maintaining the difference between teaching and administration in the universities in accordance with the law.
