PESHAWAR: The Peshawar High Court Bar Association has approached the Peshawar High Court against the results of the Provincial Judicial Service Examination, and the court has fixed the petition for hearing on October 6.

‎According to details, the Bar Association has made the Government of Khyber Pakhtunkhwa, Secretary Establishment, Khyber Pakhtunkhwa Public Service Commission, Registrar Peshawar High Court and other relevant authorities as respondents in the petition.

‎The petition states that the KP Public Service Commission had conducted an examination for 105 posts of Civil Judges-cum-Judicial Magistrates / Ilaqa Qazi, in which 1024 candidates appeared in the written examination, but only three candidates were declared successful.

‎The petitioner contends that the success of a small number of candidates in three consecutive examinations indicates flaws in the examination system and a substandard checking procedure.

‎The petition states that most of the candidates who appeared in the examination were lawyers and law graduates, but due to the current standard of checking, the candidates allegedly faced unfair evaluation.

‎The Peshawar High Court Bar has argued that the examination results are in conflict with Articles 4, 9, 10-A, 14, 19-A and 25 of the Constitution of Pakistan, while there is no effective and transparent mechanism for checking of answer sheets.

‎The petition has requested the court to declare the results of the written examination issued on September 30 as illegal, unfair and lacking transparency and to annul them.

‎It has further requested that the respondents be ordered to produce the complete record of the examination before the court and that the answer sheets of the candidates be re-examined through an independent and impartial examiner under the supervision of the court.

‎The Bar Association has also requested the court to direct the KP Public Service Commission to formulate a transparent, defined and regular procedure for checking papers for future examinations.

‎The petition further requests that till the final decision, a ban be imposed on finalizing the results, issuing any recommendations or appointment letters and re-advertising the vacant posts, while all records related to the examination be ordered to be preserved.
