PESHAWAR: (KAMRAN ALI SHAH) The Peshawar High Court has issued a written judgment on a petition filed by Sajid Raza regarding his alleged disappearance.
According to the written decision of the court, the Additional Advocate General represented the provincial government and the Senior Law Officer represented the Counter Terrorism Department (CTD).
The judgment said that petitioner Hamid Shah had requested the court to order Sajid Raza to be produced before the court, however, the senior law officer of CTD took the position that Sajid Raza was not in the custody of any law enforcement agency.
According to the court, the concerned authorities also categorically denied the allegations of Sajid Raza’s arrest or detention. Moreover, the call data record CDR revealed that Sajid Raza was in constant touch with his close relatives and friends during the alleged disappearance.
The written judgment said that no concrete evidence was produced before the court to prove that Sajid Raza was in illegal custody of a government agency.
The court held that in the present situation, there was no legal basis for declaring Sajid Raza a missing person or issuing any order to the concerned authorities, so the petition was disposed of.
The Peshawar High Court also made it clear in its judgment that the petitioners have the right to approach any alternative legal forum available under the law for redressal of their grievances.
