The Supreme Court has suspended the order of the Islamabad High Court and allowed Justice Tariq Mahmood Jahangiri to perform judicial duties.

This decision was made by the Constitution Bench of the Supreme Court during the hearing on Justice Jahangiri’s appeal. The Supreme Court issued notices to the parties on this matter and adjourned the hearing of the case until tomorrow. During the hearing, Justice Jamal Mandokhel remarked that they have the case only to the extent of the interim order of the Islamabad High Court. He said that the Supreme Court has already ruled that no judge can be stopped from judicial work. He added that there is a recent decision that ‘a writ cannot be issued against a judge by another judge.’Justice Tariq Jahangiri’s lawyer, Munir A. Malik, argued that in light of the Supreme Court’s decision, the Islamabad High Court’s order cannot be upheld.

However, Justice Jamal Mandokhel explained that the facts of the case were different from the one you are referring to. At the same time, Justice Shahid Bilal remarked that the lawyers of both sides should come prepared for this question. He added that the Registrar’s Office had objections to the petition filed against Justice Jahangiri in the Islamabad High Court, but despite this, the writ petition was numbered. The court also issued notices to the Attorney General’s Office and petitioner Mian Dawood.

It also clarified that at this stage, the matter before the Supreme Court is only to the extent of the interim order of the Islamabad High Court. It may be recalled that the Islamabad High Court had recently stopped Justice Tariq Mahmood Jahangiri from judicial work in its order, which he challenged in the Supreme Court. Meanwhile, the Supreme Judicial Council has also called a meeting on October 18 to consider matters related to Justice Jahangiri, which is considered important for the future progress in this case.
