PESHAWAR: Chief Justice Peshawar High Court reserved judgment regarding the oath-taking ceremony of the newly elected Chief Minister Sohail Afridi.
The Chief Justice started hearing the request of the Speaker and other members of the assembly. The Additional Attorney General told the Court the Governor is now in Karachi and will reach Khyber Pakhtunkhwa tomorrow, while the court’s message was conveyed to the Governor.
When the court asked whether the Governor does not have a private jet to reach timely, the Advocate General said that the Governor does not possess any private Jet. However, the Chief Justice asked when he would take the oath from the new Chief Minister. Lawyer for the Governor Amir Javed, said that the resignation of one Chief Minister could not be approved, and he would take the oath after accepting the resignation. The constitution has given the governor the authority to look into the resignation, Amir Javed Advocate said.
Presenting arguments in the Peshawar High Court, PTI Secretary General said that Chief Minister Ali Amin Gandapur was present in the assembly, and he himself said that he had resigned. Raja said that he read Article 190 (3)(b) of the Indian Constitution, the Indian Supreme Court has said that where there is no mention of approval of resignation, the resignation will be accepted, Salman Akram Raja informed the court. The Court reserved the judgment and will be announced tomorrow.
