PESHAWAR: Chairman Pakistan Tehreek-e-Insaf Barrister Gohar appealed to the Chief Justice Peshawar High Court to declare the disqualification notification of the Election Commission as null and void and decide the case as per the merit and spirit of the constitution.
Presenting arguments in the court, Barrister Gohar said that they were suddenly showered with several cases without hearing their point of view, as they requested that the real culprits be punished after investigation, but their request was not accepted.
He said that statements were recorded against them in the dark of night, a Barrister and a ten-year sentence was given, but the accused were not heard at all. If the Election Commission disqualifies someone, a reference is mandatory for it, Barrister Gohar argued.
The court asked that, first, the jurisdiction of the hearing in Abdul Latif’s case should be kept before us. Gohar replied that Abdul Latif was disqualified by the Election Commission on July 29, and when the Election Commission disqualified petitioners, the ECP did not give them any reason.
The Election Commission should carry out its responsibilities as per the Constitution, but has not been doing anything according to the Constitution for the last two years, Barrister Gohar told the court.
The Election Commission has been given this authority to de-seat individuals holding constitutional offices, and these disqualifications are against the law, and PTI appeal in the honourable court to declare this disqualification as null and void.
He said that even in America, disqualification is not done on the basis of conviction, and a constitutional body cannot be directly targeted like this.
