PESHAWAR: The Peshawar High Court (PHC) has ordered that the deputation of Saud Gundapur as the In-Charge of the Intelligence Bureau Excise Department is illegal. This decision has been issued from the bench of two judges including Justice Syed Arshad Ali and Justice Farah Jameed in response to a petition that was presented by the employees of Excise and Taxation.

As per the petition, the appointment of Saud Gundapur for the post was illegal since no Public Service Commission was followed in this matter as well as no departmental selection board was consulted. As far as the appointment of Saud Gundapur is concerned, he had been made to serve as an In-Charge of the grade 18 despite being on probation.

According to the Mashriq TV report, Advocate Asif Khan Yousafzai, who has presented this case, told that there should be a need to fill up such posts via the Public Service Commission. Moreover, a person would have to be promoted to grade 16 or grade 17 before moving towards grade 18. As far as this case is concerned, the rules concerning the appointment of the post of In-Charge have been flouted.

PHC declares Director E&SE appointment illegal

Similarly, on March 7, Peshawar High Court (PHC) has disposed of a writ petition challenging the appointment of a Grade 19 female officer as Director Elementary and Secondary Education, declaring her appointment apparently illegal.

PHC two-member bench comprising Justice Syed Arshad Ali and Justice Sadiq Ali Momand issued the verdict, directing the provincial government to appoint a new Director on merit as soon as possible.

The court stated that if the government fails to comply with the order within the specified time, the appointment of the current Director will be considered null and void.

The petitioner, Khalid Mahmood, had challenged the appointment, arguing that the post should be filled by a Grade 20 officer, as per the rules. The government had appointed the current Director, Naeema Sardar, despite the availability of senior officers.

The court noted that the appointment was made without following the proper procedure and rules, and directed the government to select a suitable candidate for the post.
